NX Network and Data Solutions Inc. (NX Fiber) services include FTTH (Fiber-to-the-Home). Shall be governed by the following terms and conditions.

1. The Subscriber shall fully pay NX Network and Data Solutions Inc. the monthly service fee rate and or charges on or before the use of the NX Fiber Services according to the Subscriber’s selected payment plan. 

2. NX Network and Data Solutions Inc. shall provide the subscriber with the necessary equipment for service access as stated in the chosen plan. Ownership of said equipment and any unit replacements or upgrades shall be the subscriber's responsibility.  

3. NX Network and Data Solutions Inc. service provided under this agreement is for the specified business purpose only. The Subscriber agrees not to resell the internet without the prior written consent of NX Network and Data Solutions Inc.. The Company reserves the right without need of demand or notice to automatically disconnect the service provided if the Subscriber violates the agreement, without prejudice to forfeiting all the sums received from the Subscriber. 

4. NX Network and Data Solutions Inc. shall not be liable for failure to Service due to any cause beyond its control such as equipment breakdown, labor disturbance or act of God. Subscriber agrees that in such a case, the operation may be suspended or terminated without notice, without liability for loss and damage, it is understood that the cause of such interruption shall be remedied. NX Network and Data Solutions Inc. shall not be liable for any loss or damage suffered by the Subscriber unless such is caused by the negligent act of NX Network and Data Solutions Inc. employees or agents. 

5. These Terms and Conditions shall take effect from the start of service and acceptance by the customer shall be effective for twelve (12) months and shall be automatically renewed for a similar twelve-month period unless terminated by either or both parties. 

6. Subscriber shall be entitled to One(1) equipment replacement due to factory defects for a warranty period of One(1) month and, service warranty period of Six(6) Months. However, the cost of repair and maintenance of equipment as a result of damage due to the act of negligence of the Subscriber; Shall be for the account of the Subscriber. 

7. Additional Installation Charges. In certain instances, the Subscriber shall pay for additional charges to cover the materials and labor for non-standard installations, depending on the length of the fiber optic. NX Network and Data Solutions Inc. is not responsible/liable for fiber cable replacement above our standard installations. 

8. The Subscriber must pay all outstanding charges by the due date indicated on the NX Fiber bill. Payments can be made at NX Network and Data Solutions Inc. office, at authorized banks, or through online partner collectors. NX Network and Data Solutions Inc. is not liable for payments made to unauthorized persons.

9. All plans of NX Fiber Micro Business Plan have a lock-in period of twelve (12) months.

10. Service Termination request not otherwise due to the fault of NX Network and Data Solutions Inc. shall have a pre-termination fee of Base Plan x 2 months.

11. Inactive subscribers for a duration of 4 months will be subject to permanent disconnection. If the customer wishes to resume the service after this disconnection, they will be subject to relocation or installation of a new account which may incur additional fees.

12. Subscribers are not permitted to switch from a Micro Business plan to a Home plan, or vice versa. Each plan type is tailored to specific usage needs, benefits, server allocations, and billing structures.

13. By using our services, you agree to the collection, use, and processing of your personal data in accordance with our Privacy Policy. This includes but is not limited to, your name, contact details, and service usage information for communication, billing, and marketing purposes. You also consent to the sharing of your data with third-party service providers as necessary for the fulfillment of our services. 

14. NX Network and Data Solutions Inc. reserves the right to modify, delete, and or add to any of the terms and conditions by giving written notice to the Subscriber.
